1. scope of application

This privacy policy at www.mantaflow.ch/datenschutz applies to visits to the website https://www.mantaflow.ch/.

Swiss data protection law (DSG) applies. Specific reference is made to any additional applicable law from the European General Data Protection Regulation (GDPR). Please note that the existence and scope of your rights may vary depending on the data protection law applicable to the specific case. Please note that this privacy policy may be subject to change from time to time.

2. purpose and basis of data processing

We process your personal data on various bases and for various purposes:

  • For the secure and stable operation of this website. We have a legitimate interest in this. For the use of analysis software and cookies, see sections 3 and 4 below (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. f GDPR);
  • To provide services that you request or to initiate such service relationships as well as to exercise all associated rights and to fulfill related obligations (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. b GDPR);
  • To contact you in response to your request. This is based on your consent or, if necessary, serves to initiate contractual relationships (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. a or Art. 6 lit. b GDPR);
  • For marketing measures, in particular for sending newsletters. We have a legitimate interest in this (legal basis within the scope of application of the GDPR: Art. 6 para. 1 lit. f GDPR). Depending on the marketing measure and applicable law, separate consent may be obtained for this (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. a GDPR). You can object to the use of your customer data for marketing purposes at any time by sending an email to info@mantaflow.ch.
  • For bookkeeping and archiving in accordance with applicable law, as well as to fulfill other legal requirements (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. c GDPR and, if applicable, Art. 6 para. 1 lit. f GDPR).

3. google analytics

Our website uses the web analysis service Google Analytics from Google Inc, USA. Google Analytics uses cookies (see under Cookies). These enable Google in the USA to analyze the use of our website, including IP addresses. We would like to point out that on this website Google Analytics has been extended by the code “gat._anonymizeIp();” in order to ensure an anonymized collection of IP addresses (so-called IP-Making). If anonymization is active, Google shortens IP addresses within member states of the European Union or in other contracting states of the Agreement on the European Economic Area, which is why no conclusions can be drawn about your identity. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google observes the data protection provisions of the “Swiss-USA Privacy Shield” agreement and therefore has an adequate level of data protection. Google uses the information collected to evaluate the use of our websites for us, to compile reports for us in this regard and to provide us with other related services. 4. CRM and marketing tools

We use the services of HubSpot Inc. (USA) and HubSpot Ireland Ltd. for contact forms, newsletter registrations, marketing automations and CRM functions. When you fill out a form on our website, the data you enter is transmitted to HubSpot and stored there. This includes in particular

  • Contact details (name, e-mail, telephone number, etc.)
  • Company-related data
  • Contents of your request
  • Technical data (IP address, browser, timestamp)

HubSpot also uses cookies and web beacons to provide forms and to analyze and assign interactions (e.g. which visitor has filled out which form). Details on the use of cookies can be found in section 5 of this privacy policy and in the HubSpot cookie policy.

The data may be stored on servers in the USA or the EU. HubSpot uses standard contractual clauses (SCC) as suitable guarantees for data transfer. HubSpot has a recognized level of data protection in accordance with the FADP and – within the scope of the GDPR – Art. 46 GDPR.

The processing is carried out for the purpose of:

  • Processing your request
  • Provision of our services
  • Maintaining the customer relationship
  • Implementation of marketing measures (e.g. newsletters, follow-ups)
  • Improvement of our web and service offering

You can object to marketing communication at any time or revoke your consent (e.g. via a link in the newsletter or by sending an email to info@mantaflow.ch). You can also block or delete cookies via your browser settings.

5. cookies

We also use other cookies on our website (session cookies as well as temporary and permanent cookies). These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. A cookie does not always mean that we can identify you.

Cookies are used on the one hand to record the frequency of use, number of users and behavior on our website, to increase the security of website use and to make our information offering more user-friendly. As soon as you leave the website, these cookies are automatically deleted.
In addition, we also use temporary cookies to optimize user-friendliness, which are stored on your end device for a specified period of time. 6. other recipients of your data

Your personal data will not be transferred to third parties for purposes other than those listed.
However, it is possible to involve contract data processors, in particular in connection with the involvement of external IT service providers. These contract data processors carry out the corresponding data processing exclusively on our behalf. They are bound by the same data protection regulations as we are.
Please note that we have no influence on mass surveillance measures by security authorities (such as the police or special security services) and cannot influence their data processing.

7. your rights

By law, you have the following rights. Please note that the existence and scope of your rights may vary depending on the specific applicable data protection legislation.

  • Information: Data subjects have the right to find out from us whether personal data relating to them is being processed and what this data is. Requests for information can be made for this purpose.
  • Rectification: If personal data is incorrect, the data subjects have a legal right to rectification.
  • Objection: If the processing of personal data is based on our legitimate interest, data subjects may object to the processing of their personal data. 8. duration of storage of personal data

Personal data of the data subjects will be stored for as long as necessary to fulfill the purposes for which it was collected or for as long as we have a legitimate interest in doing so. Legal retention obligations are also reserved.
